Dietect terms of use
1. Who these terms are with
Dietect is provided by Joshua A. Nyajuaya, an individual in Kenya trading as Konbran (“we”, “us”). By using the app you agree to these terms.
2. The app gives estimates, not measurements
Dietect estimates the contents of a meal from a photograph and from third-party food databases. Estimates can be wrong, sometimes substantially. You are expected to check and correct them. Nothing in the app is medical, dietary or nutritional advice, and it is not a medical device. If you are pregnant, have a health condition, or have a history of eating disorders, talk to a doctor or dietitian before acting on anything the app shows you.
3. Your account
You need an account to analyse photographs. Keep your password to yourself; you are responsible for what happens under your account. Tell us at [email protected] if you think someone else has access to it. You must be 18 or older to use Dietect, with or without an account.
4. Fair use
So that the service stays available to everyone, there are limits on how much any one account or device can use in a day. Do not try to work around them, automate the app, or use it to analyse anything other than your own meals. We may suspend an account that does.
5. Your content
The photographs you take stay yours. You give us permission to send them for analysis, by us and by the service provider that analyses them for us, and to store the result, as the privacy policy describes. We do not store the photographs themselves, and we do not use them to train models. Neither does that provider keep them.
6. Food data
Nutrition figures come from USDA FoodData Central and Open Food Facts; see data sources for their licences. They are supplied by those sources under their own terms, and we cannot guarantee that any individual figure is accurate or current.
7. Availability
We do not promise the service will always be available. Analysis and search depend on services we do not control, and both can fail. The app is designed to keep working locally when they do.
8. Ending it
You can stop using Dietect at any time, and delete your account from inside the app — see Delete your account. We may suspend or close an account that breaks these terms, and will tell you why unless we are prevented from doing so.
9. Liability
Nothing in these terms excludes or limits a liability that the law does not allow to be excluded or limited, including your rights under Kenya’s Consumer Protection Act and the consumer law of the country you live in.
Subject to that, the app is provided as it is and as available. We are not liable for indirect or consequential loss, for loss that was not reasonably foreseeable, or for decisions you make about your diet or health based on the app’s estimates. Our total liability to you for all claims is limited to the greater of what you paid us for Dietect in the 12 months before the claim and 100 US dollars.
10. Changes
We may update these terms. If a change matters we will update the date above and tell you in the app.
11. Governing law
These terms are governed by the laws of Kenya, and its courts can hear any dispute about them. If you use Dietect as a consumer and live elsewhere, you keep the protection of the laws of the country you live in that cannot be overridden by agreement, and you can also bring a claim in its courts.
